Everyone knows they are behind in their receipting at this time. They have channeled all resources at this time to the 485 petitions.
So much so that they suspended PPS for 140s, they don't want new 485s, even EAD/AP applications are being unduely delayed. Beyond their service commitment times with no reasons.
I think they expect to get back to normal receipting by the dates given.

Hi
I have one question , I am in my 6th year of H1 (Compeleting on Nov end). The renewal has been submitted by my employer yesterday for 7th,8th,9th year based on the approved I-140.
My wife had to travel yesterday for a family reason and she is scheduled to come back on Oct 1st. In General would there be any issue at port of entry when she comes back, as she would have only 2 months valid visa in her passport at that time.

I paper filed my EAD at NSC last month. RD was 23rd Sept & ND was 2nd Oct.
Looks like yours is a longer delay. Not sure what can be done here. Please keep checking to see if check's are cleared.

I am a green card holder, becoming eligible for citizenship in April 2009. My fianc�e has been in the US for the past 2 plus years on F1. She completes her MS in December this year .We plan to visit our home country in August this year and get married. I thought this was a relatively uncomplicated case till I read in some forum recently that marriage to a permanent resident can be a barrier to being admitted to the U.S. in F-1 status. This is because such a marriage obliterates the "non-immigrant" intent required for F-1 entrants. This could very easily jeopardize her plan to re-enter in F-1 status.
Any thoughts or advice on this? Appreciate all the help.

It is better to register you marriage here in the US, appy for your spouse Adjustment of status and travel on AP to your home country to get married. The other choice is to wait till you become a citizen and then get married.

There are very few private loan options that you have. If you have a co-signer who is permanent resident or a US Citizen, you have a bigger pool of options but I know of one organization "Access Group" who give out loan if your stay in US is more than 3 yrs + if you have 4 credit cards in your name..You can dig into more details by googling them.
Most of the schools in US also have a tie up with TMS (tuition management system) which let you pay your semester fees in monthly installments. You might want to check that out too. Hope this helps. Good Luck!

With so many proposals and so many amendments to the so many proposals (:rolleyes: ), which one would actually (or at least help to) eliminate the current backlogs (i.e., make the priority date current)? :confused:
We should make sure that any bill that potentially becomes a law will resolve the current retrogression issue (instead of making it worse).
So before we decide the bill to support, can anyone tell which bill will eliminate retrogression? Maybe we can categorize all the bills into the following types:
1. Will definitely eliminate retrogression if the bill becomes law
2. May eliminate retrogression or may make it worse if the bill becomes law
3. Will definitely make retrogression worse if the bill becomes law
4. Will have no impact on retrogression if the bill becomes law

Yes there are limits to salary. I will try to post more details on it when time permits and as I myself find details from my own research.
Basically, stay above what was in your labor/140. Do not go too high, 10% per year raise is ok. Job duties should stay same or similar. You can be a sr. software programmer from a software programmer but not a VP or Architect...(you got my point).
This is a gray area and tough to get a correct advice easily.
This is also a big issue for our community since people cannot get promoted or take big salary raises due to this limitation. Ask people who are stuck in 485 stage for many years.
I know a lot of people are counting days to just jump into a new job after 180 days. But make sure you factor in all the risks when you do this. Be prepared for an RFE on it.
and BTW I am reading so many posts that say you can jump jobs before 180 days. Please do not misrepresent the Yates Memo and regulations to prove a point. You need to stck to the job for 180 days definitely. The only exception is that if you are sure that the job offer will wait for you indefinitely in infinite future when you get an RFE. Do not take immigration laws lightly. And yes, always seek advice from a good lawyer when you take such important decisions. Forums are simply opinions from people without a law degree or experience.

Always look at last action taken by the USCIS. If USCIS approved your H-1B for employer D, and attached I-94, that means that as long as you are working for employer D at this time and at the time you extend and re-stamp your H-1b visa, there should be no problem. Make sure you take W-2s and Tax returns from previous years you were in H-1B status when you go for a new Visa Stamp.
